On Thursday, the New Hampshire House will consider a bill making the Exculpatory Evidence Schedule public.

HB 155, as amended by the House Judiciary Committee, calls for the contents of the EES, formerly the Laurie List, to be subject to the state’s Right-to-Know law, meaning the public would be able to view the names of the police officers listed and the nature of the offense or offenses that put them on the list in the first place.

Attorneys for the New Hampshire Department of Justice argue the names of officers on the list, and most other information it includes, are confidential because that information is an extension of the officers’ personnel files, which are confidential in their entirety by law.
